Osram Optoelectronics sues Taiwan LED infringer


Osram has filed a lawsuit against Taiwanese LED manufacturer Kingbright and its German subsidiary Kingbright Europe GmbH in the Düsseldorf District Court in Germany. OSRAM Optoelectronics sees this ruling as a manifestation of the company's efforts to strengthen intellectual property rights in LED production.

In this lawsuit, OSRAM emphasized that Kingbright has infringed and still infringes patent rights in Germany by importing, selling and supplying certain white and surface mount LEDs. OSRAM intends to seek restraining orders and claim compensation. Kingbright must stop importing LEDs in Germany and produce some of these LEDs.

Long Opto Semiconductors emphasizes that Kingbright has infringed and still infringes in Germany by importing, selling and supplying certain white and surface mount LEDs. OSRAM intends to apply for an injunction and claim compensation. Kingbright must stop importing LEDs and Kingbright products containing these LEDs for sale in Germany. Distributor D. Schuricht GmbH & Co. KG was also subject to the same lawsuit for selling such infringing products in Germany.

One group of products involved in legal proceedings is a white LED with conversion technology. Typical applications include backlighting for mobile phones and automotive radio displays. This technology was developed by OSRAM in the mid-to-late 1990s. It allows white LEDs with blue-emitting InGaN chips to be illuminated by a suitable phosphor converter. OSRAM is the first manufacturer to introduce white light single-chip LEDs in the market. Another group of patented technologies is the design of LED electronic connection architecture and housing, especially surface mounting technology. These LEDs are commonly used in automotive lighting applications, including interior lighting and tail combination lighting systems. Other LED manufacturers, such as Dominant in the US and Germany, are subject to the same patent litigation. OSRAM calculates that it continues to take appropriate action around the world to protect its intellectual property.

Rüdiger Müller, CEO of OSRAM Opto Semiconductors, stated that our legal action against Kingbright was to prevent the use of our technology without our consent. Kingbright has licensed the LED market from other manufacturers such as Intematix USA. This means that obtaining patents from these companies does not automatically avoid infringement of Osram's patents.
